The Allahabad High Court in the case Aditya Raj Verma vs. State Of U.P. . And Another observed and has granted bail to the man accused of raping his married live-in partner, it has also been difficult for a woman to live alone after breaking of live-in relationship.
In the present case, the court while opining the Indian Society at large, does not recognize such relationships as acceptable, the court added a women, therefore, there is being no such option with but for lodging a first information report against her live-in partner.
The bench comprising of Justice Siddharth in the case observed while dealing with the bail plea of one Aditya Raj Verma who is being arrested on 24.11.2022, on the charges which being resiling from his promise for marrying her live-in partner.
It being the case of women, wherein a married women, the Verma (who being the applicant) was living with her for the past 1 & 1/2 years and she became pregnant on account of her live-in relationship with him, thus, he refused to marry him.
It has also been alleged that he sent obscene photographs of the victim to her husband and therefore, he refused to keep her with him.
The applicant appearing before the court submitted that the victim being major and is willingly entered into a live-in relation understanding the consequence of such a relation and that there being no such allegation that the relation started with the promise of marriage.
The court observed that this being a case where the disastrous consequences of a live-in relationship have come into the scene.
Subsequently, the court is of the view that the nature of the offence, the evident, the complicity of the accused and finding force in the submissions made by the counsel for the applicant and the one-sided investigation which is being conducted by police, ignoring the case of the accused side.
Accordingly, the court granted the bail.
