A Delhi court has passed an order for the framing of charges against former Bihar MLA Raju Singh, his wife, and two other individuals in connection with a case of celebratory firing that took place during a New Year’s Eve party at a farmhouse. Tragically, a woman lost her life during the incident.
“The actions of accused Raju Singh, who fired from his licensed pistol at the New Year’s party, indicate his awareness that such firing in a crowded gathering could result in the loss of life. Consequently, accused Raju Singh is prima facie liable to face charges under section 304 (Part II) of the IPC and under section 30 of the Arms Act,” stated Special Judge Vikas Dhull.
Additionally, the judge has ordered the framing of charges related to the destruction of evidence against Raju Singh’s wife, Renu Singh, and his associates, Ramendra Singh and Rana Rajesh Singh. He has determined that there is sufficient evidence on record to establish the basis for charges against Ramendra Singh and Rana Rajesh Singh under section 201 (destruction of evidence) and section 34 (common intention) of the Indian Penal Code (IPC). Charges under section 201 of the IPC have also been ordered against Renu Singh.
Advocate Nitesh Rana, representing the politician, opposed the framing of charges, contending that the prosecution lacked the necessary evidence to support its case against him.
The celebratory firing incident occurred at the politician’s farmhouse on December 31, 2018. Initially, the accused individuals were charged under the relevant sections of the IPC and the Arms Act. Subsequently, the police added section 302 (murder) of the IPC, which carries a maximum penalty of the death sentence, to the FIR after the victim succumbed to bullet injuries. However, the court discharged the accused of this section, accepting the argument made by Rana that the offense was not established.
