On Friday, the Supreme Court informed the Delhi government of its intention to consider the petition challenging the central government’s law, which grants the lieutenant governor supremacy over the elected administration in managing services in the national capital.
Delhi Services Bill
The Government of National Capital Territory of Delhi Bill 2023, also known as the Delhi Services Bill, was passed by Parliament. This legislation significantly empowers the lieutenant governor in matters pertaining to services. Subsequently, upon receiving the president’s assent, the bill was enacted into law.
Urgency Stressed by the AAP Government
Senior advocate Abhishek Singhvi, representing the AAP government, raised urgent concerns before a bench comprising Chief Justice D Y Chandrachud and justices JB Pardiwala and Manoj Misra. Singhvi emphasized that the entire administration has come to a standstill, highlighting the critical nature of the issue. Chief Justice D Y Chandrachud acknowledged Singhvi’s concerns, noting that a case involving a nine-judge bench is currently in progress. However, he assured Singhvi that he would give careful consideration to the submission.
Previous Supreme Court Directive
Previously, the Supreme Court had directed a five-judge Constitution bench to address the Delhi government’s petition challenging an ordinance issued by the Centre on May 19 of the preceding year. This ordinance stripped the city administration of its authority over services, leading to renewed tensions between the central and local authorities.
Importance of Elected Government Oversight
In a prior ruling, the apex court emphasized the importance of an elected government having control over bureaucrats. It underscored that without such authority, the principle of collective responsibility would be compromised.
