High Court Ruling: Spouses Empowered to Seek Aid Amid Extramarital Affairs

The Punjab and Haryana High Court recently emphasized the justifiability of seeking external assistance when a spouse is engaged in extramarital affairs. In a recent case presided over by a Division Bench comprising Justice Sudhir Singh and Justice Harsh Bunger, the Court addressed an Army major’s plea for divorce, wherein his wife had filed complaints with his superiors alleging his involvement in multiple extramarital relationships.

Highlighting the need for substantial evidence to substantiate claims of cruelty in matrimonial disputes, the Court stressed that baseless allegations cannot suffice as grounds for divorce. However, the Court underscored that if a spouse has legitimate concerns regarding their partner’s behavior, seeking intervention from supportive individuals or authorities is warranted to preserve marital harmony.

In the case at hand, the High Court upheld the trial court’s decision, emphasizing that the husband’s accusations lacked substance while acknowledging evidence suggesting his unethical conduct.
