The Gujarat High Court has ordered “status quo” on the alleged illegal construction of a temple on land belonging to the Shardanagar Cooperative Housing Society in Ahmedabad’s Paldi area.
Justice Sangeeta Vishen, while issuing notices to the Ahmedabad Municipal Council (AMC) and other authorities, directed, “Till the next date of hearing, the parties are directed to maintain status quo.”
The matter is scheduled for the next hearing on August 29.
Senior advocate GM Joshi, representing the petitioner society, stated that the private respondents had purchased the super-structure and claimed not to be members of the society. It was noted that a suit filed by the respondents before the Board of Nominees had been rejected on the grounds that the respondents were not members of the society.
Advocate Joshi further argued that the municipal corporation had issued a notice to the private respondents, instructing them to remove the illegal construction and/or to halt the work, as it was being carried out without permission. Despite this, the construction of the temple continues unabated, according to the petitioner.
The counsel stressed that the land belongs to the residential society and that only its members have ownership of the superstructures, while non-member tenants do not have official plots.
