SCBA Criticizes Police Violence

The Supreme Court Bar Association has condemned the alleged violent actions of police against advocates within the Ghaziabad court premises, calling the incident a serious violation of rights and the rule of law.

The SCBA criticized the Uttar Pradesh Police for their aggressive behavior, particularly under the direction of District and Sessions Judge Anil Kumar-X, labeling such actions as unacceptable and detrimental to the integrity of the judicial system.

In a strong resolution, the SCBA asserted that it will not tolerate any attacks on the dignity of advocates. In response to the recent events, the association demands immediate action from both the Allahabad High Court and the Uttar Pradesh Government to effectively address the situation.

The SCBA specifically calls for an inquiry into Judge Anil Kumar-X’s conduct, advocating that a sitting judge of the Allahabad High Court, including the Chief Justice and the Administrative Judge overseeing Ghaziabad, lead the investigation.

They emphasize the need for a comprehensive investigation into the incident, ensuring accountability for both the judge and the police officers involved.

Moreover, the SCBA demands the dismissal of Anil Kumar-X along with the police officers responsible for the lathi charge, as well as compensation for the advocates who were injured during the incident. To prevent such occurrences in the future, they urge the implementation of protective measures for advocates and their families, including the introduction of the Advocates Protection Act.

Additionally, the SCBA calls on the Bar Council of India and all State Bar Councils to take necessary steps to safeguard advocates’ rights, ensuring they can carry out their duties without fear of intimidation or harassment.

The association stands firmly in solidarity with the advocates of Ghaziabad and pledges to take all necessary actions to ensure that justice is served.

The SCBA’s resolution underscores the critical importance of maintaining a safe and respectful environment for legal professionals. As advocates continue to play a vital role in upholding justice, it is imperative that their rights are protected, and that any violations are addressed swiftly and decisively.
