The Delhi High Court on Wednesday has summoned US-based AI firm OpenAI following a lawsuit filed by news agency ANI.
The case alleges that OpenAI used ANI’s content without authorization to train and operate its AI tool, ChatGPT, in violation of copyright laws. This marks India’s first legal challenge against a major AI company over such claims.
ANI is seeking Rs 2 crore in damages and a permanent injunction to prevent OpenAI from using its content further. Justice Amit Bansal, overseeing the case, declined to grant immediate relief, citing the complex legal issues surrounding AI technology and copyright.
The court suggested the appointment of an amicus curiae to provide expert assistance.
OpenAI’s Response
OpenAI’s legal team informed the court that links to ANI’s content, including its official website, have been removed and access blocked.
However, ANI’s counsel argued that the infringement goes beyond copyright violations, pointing to instances where ChatGPT falsely attributed content to ANI, raising concerns about potential misinformation.
OpenAI has denied any wrongdoing, stating that its AI system corrects errors when identified. The next hearing is set for January 2024.
OpenAI’s Restructuring Plans
In a related development, OpenAI is reportedly planning to shift from its current non-profit-controlled model to a for-profit benefit corporation, aiming to attract more investors while maintaining minority control by its non-profit arm.
