Allahabad HC Turns Down Appeal Seeking Appointment Of Receiver For Jaigurudev Sanstha

The Allahabad High Court on Thursday has dismissed an appeal filed by the Jaigurudev Dharma Pracharak Sanstha, seeking the appointment of a receiver to manage its properties and funds in Mathura.

The appeal challenged a decision by the Civil Judge (Senior Division) in Mathura, which had rejected the request, citing insufficient evidence to justify such an appointment.

Senior advocate Anil Bhushan, representing the Sanstha, argued that respondent Pankaj Yadav had unlawfully taken control of the society and its assets. Bhushan highlighted that when conflicting claims for the society’s presidentship arose, the assistant registrar had previously recognized Yadav as the legitimate president.

He alleged that Yadav had engaged in various illegal activities and misappropriations, including executing unauthorized property sales and failing to provide proper financial accounts.

Despite these claims, Justice Kshitij Shailendra upheld the lower court’s findings, emphasizing that no substantive evidence was presented to support the allegations. “This court is of the considered view that except making bare allegations of mismanagement and misappropriation of the properties and funds in the hands of respondent nos. 1 and 2, nothing substantial was brought on record,” Justice Shailendra stated in the order issued on November 12.

The court also pointed out that even regarding the claims of unauthorized property sales, the names of the vendors involved were not disclosed, further weakening the case. As a result, the appeal was dismissed for lack of credible evidence.

This ruling reaffirms the judiciary’s stance that unsubstantiated allegations alone cannot form the basis for appointing a receiver to manage organizational properties.
