Forgery Case: Delhi HC Grants Anticipatory Bail To Bobby Kinnar

The Delhi High Court on Thursday granted anticipatory bail to Bobby Kinnar , Delhi’s first transgender MCD Councillor, in a case involving allegations of obtaining a caste certificate through fabricated documents.

Earlier, Bobby request for anticipatory bail was dismissed by the trial court.

Justice Amit Mahajan, while hearing submissions from Bobby counsel and the Delhi police, noted that Bobby had cooperated with the investigation, having appeared for questioning three times. The court ordered that Bobby be granted bail upon furnishing a personal bond of Rs 25,000 in case of arrest. Her petition to quash the FIR filed against her will be heard in February 2025.

The FIR was registered following a complaint filed by a defeated Congress candidate, alleging that Bobby obtained a Scheduled Caste certificate using forged documents to contest the MCD election from the Sultanpuri ward in 2022.

The complaint led to an investigation, and the matter was examined by Rohini Court, which had dismissed her anticipatory bail plea in October.

The court stated that her custodial interrogation was necessary and suggested the possibility of a larger nexus involving the issuance of fraudulent caste certificates.

The trial court had raised concerns about the blurred and illegible documents submitted during the application process, particularly the rules that were allegedly violated by authorities in Gautambudh Nagar, Uttar Pradesh, when issuing the certificate.

The court speculated that this might be part of a larger conspiracy involving multiple individuals.

Despite the setback in the trial court, Bobby’s legal team moved the High Court for anticipatory bail, which has now been granted.
