Delhi HC Grants Interim Bail To Jitender Gogi’s Co-Accused On Grounds Of Wife’s Surgery

The Delhi High Court has recently granted interim bail for 15 days to Prince, also known as Sandeep or Mota, who is currently facing charges in a high-profile gang-related murder case.

He is accused of being involved in the killing of Kunal Mann, a member of the Tillu Tajpuria gang, alongside notorious gangster Jitender Gogi and others.

Murder Tied To Inter-Gang Violence

Kunal Mann was shot dead on February 10, 2021, in a suspected revenge killing. The police allege that Deepak alias Boxer, Mohit, and Chhota Boxer carried out the murder to avenge the death of Kulbeer, also known as Mathur. Following the incident, an FIR was filed at Alipur Police Station, and Prince was arrested on February 12, 2021.

At the time, Jitender Gogi was in jail. He was later killed in a dramatic courtroom shootout in Rohini in September 2021, allegedly orchestrated by members of the Tillu gang. In a continuation of the brutal gang rivalry, Tillu Tajpuria himself was murdered in Tihar Jail in May 2023, reportedly by Gogi’s associates.

Bail Granted Due To Wife’s Medical Emergency

On June 25, Justice Manoj Jain granted Prince a temporary release on humanitarian grounds so he could care for his wife, who is scheduled to undergo spinal surgery.

“The application is allowed, and interim bail is granted to the petitioner/applicant for 15 days to be reckoned from the date of his release on his furnishing personal bond and surety bond for Rs 50,000 each to the satisfaction of the learned Trial Court/ learned Duty MM,” the court said in its order.

Prince had originally requested a 45-day interim bail. His lawyer, Advocate C.M. Sangwan, argued that there is no one else available in the household to care for his wife. He also highlighted that Prince has two minor children and an elderly grandmother dependent on him.

Prosecution Objects, But Court Weighs Family Circumstances

The Additional Public Prosecutor opposed the bail request, citing Prince’s role as a co-accused in a serious murder case involving Deepak alias Boxer. Despite acknowledging the gravity of the charges, the court took a balanced view based on the family’s situation.

“Undoubtedly, the allegations against the accused are serious in nature, but keeping in mind the fact that there is no other male member in the family and the wife of the petitioner has to undergo spinal surgery, the case for interim bail is made out,” the judge observed.

Prince’s 15-day interim bail will begin from the day of his release, once he fulfills the required bond conditions.
