Rape Case: Delhi Court Grants Bail To Actor Ashish Kapoor

The Tis Hazari Court in Delhi has granted bail to television actor Ashish Kapoor, who had been in judicial custody after being arrested in connection with an alleged gang rape case.

Kapoor was picked up from Pune, Maharashtra, and has been under police scrutiny following his arrest on September 2, 2025.

Bail Approved With Conditions

On September 10, Additional Sessions Judge Bhupinder Singh allowed Kapoor’s bail application after reviewing documents, CCTV footage, and submissions from both sides. The court ordered him to submit a bail bond of ₹1 lakh along with a similar amount as a surety.

The judge emphasized that Kapoor was not needed for further investigation and that he maintained a clean record. “Given the materials on record, including CCTV footage, and the fact that the accused is no longer required for investigation, being a permanent resident of Delhi with clean antecedents, I find merit in the bail plea, which is accordingly allowed,” the court remarked.

Police Custody Questioned

While granting bail, the court pointed out deficiencies in the police investigation. The police had requested five days of custody for Kapoor but were granted only 4 days by the magistrate. However, Kapoor was returned to court within three days, indicating that extended custody was unnecessary.

The judge further observed, “Despite being on police custody, no serious steps were taken to recover the accused’s mobile phone. Searches were not conducted as per protocol, and nothing on record suggests that the accused failed to cooperate with the investigation.”

Defence’s Stand

Kapoor’s defence team, which included Advocates Deepak Sharma, Ravish Dedha, Rajan Oberoi, and Somesh Oberoi, argued that the allegations were baseless and intended to pressure Kapoor into paying money. Advocate Sharma presented that the complainant had arrived at the party highly intoxicated and was seen hugging various guests and bartenders.

The defence also highlighted the complainant’s history of filing complaints, including one earlier this year against her landlord at Janakpuri Police Station. Furthermore, it was pointed out that another accused, Kapil Gupta, a pilot, had already been granted anticipatory bail, and Ritu Gupta, another alleged accomplice, is a businesswoman, suggesting Kapoor’s cooperation wouldn’t be an issue.

Details Of The Case

The case was registered on August 11, 2025, after the complainant alleged that she was administered a spiked drink at a party in Kapoor’s neighborhood, resulting in her losing consciousness and being sexually assaulted in a washroom.

Kapoor was sent to 14 days of judicial custody on September 6 following police interrogation. The case involves sections related to rape, gang rape, and causing hurt.
