Supreme Court: Matrimony based onmutual love and affection; not on termsand conditions

The Supreme Court orally observed that the Matrimony is based on mutual love and affection and not on terms and conditions. The bench comprising of Justice MR Shah and Justice CT Ravikumar in the case observed and has made this comment while hearing a plea pertaining to a marital dispute between a husbandwife duo. Therefore, it has been informed by the advocates during the hearing for both the parties informed that that they were interested to give the marriage one more try. Therefore, the counsel appearing for the wife requested before the bench that the said matter is to be referred to the Supreme Court Mediation Centre. At this point, the bench didn’t quite understand the need for mediation. The bench headed by Justice Shah stated that, what being the need of mediation? The Husband and wife are ready to go with each other. Then what being the need? Last time, the court recorded your submission and granted you time. Do not waste the court time, be sure (of your decision). Adding to which, the counsel responded that a mediation session is required to discuss terms and conditions. It has been asked by Justice Ravikumar, you want a written terms and conditions to ensure that each day whether it is complied with or not? Everyday, you are looking into it? Whether husband has complied with condition number 2 or number 3? It was then informed to the court that the husband is working in Saudi Arabia. Further, the bench commented that, your client will have to go to Saudi Arabia. Sita-ji went with Ram, no? Follow Sita-Ram The advocate informed the bench that she is wiling to go there. The bench then referred the matter to the Supreme Court Mediation Centre owing to the parties’ joint request on February 6 and allowed the Respondent husband to join virtually for the session. Accordingly, the court listed the matter to be next heard on March 30
