Karnataka High Court: If Mother Have Illicit Affair, Will Child Custody Be Given To Father

The Karnataka High Court on Saturday upheld the Family Court order in giving the custody rights of a minor child to father.

After knowing his wife’s illicit relationship, her husband filed a case for custody of the child. The external relationship of the woman with another man has become the reason that the child’s father sought minor’s custody.

The Family Court on March 3, 2022 stated in its order to hand over the custody of the minor child to the husband.

The division bench of Justice Alok Aradhe & Justice S Vishwajith Shetty stated in their judgment that “The material on record would go to show that the appellant was not only behaving rudely with the respondent & her in-laws, but also had behaved rudely during the family counselling. She was in the habit of quarrelling with the respondent in public and she was never truthful to the respondent or her in-laws.”

The Court also said that the husband has proved the woman was not giving priority to the child. And therefore, observed in its judgement that “she was rude and has given more priority to her illicit relationship & neglected her child.”
