High Court Directed Calcutta University To Register Botany Students Of State-Aided College Lacking Affiliation: ‘Students Not At Fault’

The Calcutta High Court in the case Behala College v. University of Calcutta & Ors observed and has directed the University Of Calcutta for granting the registration numbers and the admits cards to the students of B.Sc. Botany (Hons.) of the Behala College for the academic session 2022-2023, the students who are being declined on the ground that the said college could not fulfil the condition for the ‘extension of affiliation’ to the University of Calcutta. Th bench comprising of Justice Kaushik Chanda in the case observed and has allowed the plea wherein stating that the students are not at fault as the courses were being offered by a State aided college that they have taken of the admissions under the bona fide belief that the course had due affiliation from the university. In the plea, the petitioner college granted an extension of affiliation” on November 11, 2019 for the latter which is being issued by University of Calcutta for Botany (Hons.) course provisionally only for three years with effect from the academic session 2019-2020, on the condition that three more full-time teachers in addition to the existing strength for Botany (Honours) is to be appointed or the session 2019-2020 and requested for not admitting any students until an affiliation letter is received by the college from the university.
It was also been submitted by the respondent university before the court that despite the failure of college to fulfil the said condition wherein the students of Botany (Hons.) of the college are allowed to appear in the examination by providing the students with the registration numbers for the academic sessions of 2019-2020, 2020-2021, and 2021-2022. Therefore, it has been declined by the University for granting registration numbers to the students of B. Sc. Botany (Honours) of the said college for the academic session 2022-2023 as the college failed to fulfil the stated condition.
The counsel, Kishore Dutta, Senior Advocate appearing for the college submitted before the court that the college has taken all steps to fulfil the conditions as contained in the letter dated 11.03.2019 by recruiting three whole time visiting teachers. Further, it has been stated by him that the selection process has been completed and the panel is sent to the State for approval.
It has also been directed by the court to the college to immediately send the necessary papers to the university to obtain registration and admit cards for the students of the said course. Further, the court directed the college to send necessary papers to the University for Affiliation within two months which shall be considered by the University as per the law. Accordingly, it has been made clear by the court that the college will be debarred from admitting any students to Botany (Honours) Course until the college obtains the necessary affiliation from the university.
