A complaint has been filed to the acting Chief Justice of the Delhi High Court against the protest organized by the Aam Aadmi Party’s legal cell in connection with the arrest of Chief Minister Arvind Kejriwal. The legal cell has announced a protest in all Delhi courts on Wednesday.
Complainant Vaibhav Singh, a practicing advocate, seeks an immediate halt to the illegal protest called by the legal cell and political workers of the Aam Aadmi Party (AAP) within the court premises. He requests appropriate direction to the Bar Council of India and the Bar Council of Delhi to thoroughly investigate the matter for professional misconduct.
The complainant also requests direction from the bar associations of all district courts and high courts to initiate disciplinary proceedings against the lawyers and political workers participating in the illegal protest within the court premises.
“The Legal Cell of the Aam Aadmi Party should be penalized appropriately for calling an illegal protest within the court premises of Delhi,” the complaint stated.
According to the complaint copy, it has become a trend for members of political parties to involve their legal cell members by calling for strikes, protests, boycotts, or token strikes to pressure law enforcement agencies, and sometimes even to pressure the judiciary.
The complaint copy further states that Sanjiv Nasiar (Advocate), from the AAP Legal Cell and also Vice-Chairman of the Bar Council of Delhi, posted a video on his Twitter handle on March 26, calling the arrest of Chief Minister Arvind Kejriwal illegal. Nasiar also alleged that the arrest by the Enforcement Directorate was at the behest of the central government. These false and baseless allegations against law enforcement agencies and the central government, followed by the use of court premises as a battleground for political parties, constitute gross misconduct of professional ethics, violating the Rules of the Bar Council of India and disregarding the directions of Supreme Court judgments.
The Aam Aadmi Party (AAP) Legal Cell has called for a protest in all the courts of Delhi on Wednesday at various locations across the national capital, including the Delhi High Court, Patiala House Court, Dwarka Court, Saket Court, Karkardooma Court, Tis Hazari Court, and Rouse Avenue Court.
