The Bar Council of India (BCI) informed the Delhi High Court on Tuesday that it will investigate and decide on the PIL demanding that the Right of Children to Free and Compulsory Education Act, 2009 (RTE Act) be made a mandatory subject for LLB students across the country.
The counsel appearing for the BCI made the statement before a bench of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad.
Following the recording of the statement, the bench disposed of a PIL seeking the aforementioned relief.
The petition was filed by an organisation called Social Jurist, represented by advocates Ashok Agarwal and Kumar Utkarsh.
It stated that, despite the fact that the RTE Act was passed many years ago, few students, lawyers, or even judges are aware of its provisions.
According to the petitioner organization, they have made representations to the BCI as well as several other authorities on the issue, but nothing has been decided.
The plea stated, “It is submitted that a large part of the current inaction regarding violations of the right to education stems from law students and lawyers being taught nothing about the right to education. In fact, the vast majority of them are unaware of the fundamental rights enshrined in the RTE Act of 2009.”
