BJP IT Head Amit Malviya Moves Delhi HC Over Defamatory Tweet by Samajwadi Party Media Cell

Amit Malviya, head of the BJP IT department, approached the Delhi High Court regarding a tweet posted by the ‘Samajwadi Party Media Cell’ on a social media platform, which he claims is objectionable.
Malviya’s counsel argued that the tweet, published on ‘X’ on August 3, is “defamatory” and “utterly scandalous,” and has caused significant harm to his reputation.
Justice Vikas Mahajan, after hearing arguments from senior lawyers who requested urgent action to remove the “defamatory” content, indicated that he would issue an order on the matter.
“Every day it receives 5,000-10,000 views. Each day is critical. Such statements should not be allowed to be seen by anyone,” Malviya’s counsel stated.
The head of the BJP IT Cell alleged that following his tweet condemning the brutal gang rape of a minor girl in Ayodhya, the Samajwadi Party Media Cell retaliated with a personal attack, falsely accusing him of sexual misconduct.
“The allegations are gravely injurious to the plaintiff’s dignity and reputation, particularly given his status as a public figure. The statements, which are scandalous, fabricated, and reckless, have been widely published, circulated, and viewed by the public, significantly diminishing the plaintiff’s reputation,” the lawsuit asserts.
Malviya’s suit further alleges that the statements were motivated by wrongful intent and represent a deliberate attempt to tarnish his reputation.
