BJP Leader Subramanian Swamy Moves Delhi HC against LOP Rahul Gandhi
Bharatiya Janata Party (BJP) leader Subramanian Swamy has moved the Delhi High Court, seeking directions for the Ministry of Home Affairs (MHA) to act on his representation to revoke the Indian citizenship of Congress leader and Lok Sabha Leader of Opposition (LoP) Rahul Gandhi.
The plea is expected to be heard by the High Court next week.
In 2019, Swamy had written to the MHA, alleging that a company named Backops Limited, registered in the United Kingdom in 2003, listed Rahul Gandhi as one of its Directors and Secretary.
According to Swamy, Gandhi declared his nationality as British in the company’s Annual Returns filed on October 10, 2005, and October 31, 2006. Additionally, Gandhi’s nationality was also stated as British in the company’s dissolution application dated February 17, 2009.
The BJP leader contends that this declaration is a violation of Article 9 of the Constitution of India and the Indian Citizenship Act, 1955.
The MHA had written to Gandhi on April 29, 2019, requesting him to “intimate the factual position” on the matter within a fortnight. However, Swamy has argued that more than five years have passed since his letter, yet there is still no clarity from the MHA on what decision has been made.
