Delhi’s Rohini Court has recently granted bail to a Gangster who is accused of extortion call to a restaurant owner from jail.
Earlier, the gangster was accused of making an extortion call to a restaurant owner from inside the jail has been granted bail by Delhi’s Rohini Court.
The accused, known as Harsimran alias Badal, previously opened fire at the restaurant on 2 occasions before making the alleged extortion call while in custody.
Notably, ASJ Gaur stated that, “The charges have not yet been framed, and the trial will take its own time. The further custody of the applicant/accused is not required for trial.”
The accused has a total of 22 cases against him, including one registered under the Maharashtra Control of Organized Crime Act. He was arrested in October 2020.
After considering the facts and circumstances of the case, the court granted bail to the accused on May 27, with a bond amount to Rs 35,000 and one surety of the same amount.
According to the prosecution’s case, the complainant owns a restaurant in Shalimar Bagh, Delhi. On August 8, 2020, an individual handed over his phone to the complainant and asked him to speak to a person named Badal Bhai. The person claimed responsibility for the earlier firing incident at the restaurant and threatened to kill the complainant, as described by a police officer.
Further, on August 18, 2020, the officer explained that two boys visited the restaurant and handed a phone to the owner. The person on the other end demanded Rs2 lakh.
When the two boys returned to the restaurant on August 20, 2020, they were reprimanded by the complainant’s uncle.
The officer added that, “On August 23, 2020, 3 boys came on a motorcycle and 2 of them opened fire at the eatery before fleeing the spot. A chargesheet was filed under sections 387 and 506 of the IPC and under Arms Act.”
Advocate Ankit Tyagi, the counsel for the accused, argued that his client had been in custody since October 5, 2020. With charges yet to be framed and the trial expected to be prolonged, Tyagi asserted that further custody was unnecessary.
He also highlighted that no complaint was lodged regarding the firing incident at the eatery, as mentioned in the FIR.
He argued further that there was a delay in filing the FIR. The last bail application was dismissed on June 18, 2021, before the filing of the chargesheet.
However, the additional public prosecutor opposed the bail application, stating that the accused was the mastermind behind the plan to extort the complainant. The APP also mentioned that the accused was involved in around 22 other cases and that two mobile phones were recovered from his possession while behind bars.
