Defamation Case: Delhi HC Seeks Tajinder Bagga’s Response Filed By Subramanian Swamy

The Delhi High Court has requested BJP leader Tajinder Pal Singh Bagga to respond to a plea filed by former Rajya Sabha MP Subramanian Swamy.

Swamy is challenging the summons issued against him in a defamation case initiated by Bagga.

Background Of The Case

In September 2021, Subramanian Swamy tweeted that Tajinder Bagga had been jailed multiple times for petty crimes before joining the BJP. Bagga contends that this statement is false and defamatory, leading him to file a criminal defamation complaint under Section 500 of the Indian Penal Code.

On March 22, 2022, the Additional Chief Metropolitan Magistrate (ACMM) found sufficient grounds to proceed and summoned Swamy as an accused. Swamy subsequently approached the Delhi High Court, seeking to quash the summons and the ongoing trial court proceedings.

Court Proceedings

The High Court initially stayed the trial court proceedings and issued a notice to Bagga. Justice Dinesh Kumar Sharma, presiding over the matter, questioned the maintainability of Swamy’s plea, noting that he should have first approached the sessions court before moving to the High Court. The court has asked Swamy to provide arguments on this procedural aspect.
