Delhi Bungalow Allocation Row: AAP MP Raghav Chadha Moves HC against Trial Court Order

AAP MP Raghav Chadha on Tuesday moved the Delhi High Court, challenging a trial court’s decision to lift an interim order that had prevented the Rajya Sabha secretariat from evicting him from the government bungalow allocated to him.

The plea was mentioned before a bench comprising Chief Justice Satish Chandra Sharma and Justice Sanjeev Narula, who agreed to schedule it for Wednesday.

Chadha’s counsel stated that the Member of Parliament (MP) had received a notice, and eviction proceedings were underway. She pointed out that there had previously been a stay granted by the trial court, which has now been lifted.

On October 5, the trial court issued an order stating that Chadha could not assert an absolute right to remain in the government bungalow for the entire duration of his tenure as a Rajya Sabha MP, even after the allotment was canceled. The trial court made this observation while vacating an interim order passed on April 18, which had directed the Rajya Sabha Secretariat not to evict Chadha from the government accommodation. The court had noted that the interim relief had been granted to Chadha to ensure that he would not be dispossessed from the residence without due process of law.
