Raghav Chadha Won’t Have To Vacate Govt Bungalow, DHC Allows his Plea against Trial Court Order

The Delhi High Court on Tuesday allowed AAP Leader Raghav Chadha plea challenging the trial court’s decision to vacate its interim order that had prevented the Rajya Sabha Secretariat from evicting him from the government bungalow allotted to him. This trial court decision had paved the way for Chadha’s eviction.

A bench of Justice Anup Jairam Bhambhani ruled that the trial court’s April 18 order, which had directed the Rajya Sabha Secretariat not to evict Chadha, stands revived.

Chadha had contested the trial court’s October 5 order, which had vacated the April order. The court, in its recent order, stated that Chadha could not assert an absolute right to occupy the government bungalow for the entire duration of his tenure as a Rajya Sabha MP, even after the allotment’s cancellation.

Chadha’s legal counsel argued in the high court that the MP had been served with an eviction notice, and eviction proceedings were underway. The Rajya Sabha Secretariat opposed his petition against the trial court’s decision.
