Delhi HC Dismisses Plea Challenging Airlines and Air India Merger

The Delhi High Court has dismissed a plea challenging the merger of Tata Singapore Airlines Limited (SIA) Vistara and Air India.

A single bench of Justice Sanjeev Narula observed that the petitioner, Captain Deepak Kumar, had presented unsubstantiated and reckless allegations lacking evidence and driven by malice.

“The claims are made without any regard for truth and appear to be designed to manipulate or mislead. This approach not only discredits the Petitioner’s credibility but also burdens the legal system unnecessarily. Therefore, in the Court’s view, given the absence of any substantiated claims and the apparent malicious intent behind the allegations, the present petition lacks merit,” the bench stated.

It is to be noted that recently, a division bench had rejected Kumar’s plea to bar Prime Minister Narendra Modi from contesting elections for allegedly taking a false oath of allegiance to the Constitution of India.

The bench had questioned Kumar’s mental fitness and instructed local police officials to keep him under observation.

In the current case, Kumar challenged the Competition Commission of India (CCI) decision rejecting his plea against the merger of Vistara and Air India, alleging bid rigging and cartelization.

After reviewing the case, the single bench dismissed Kumar’s plea and concurred with the division bench’s observations regarding Kumar’s mental condition.
