Delhi HC Issue Notice To Telecom Department On Plea Against Phone Interception

The Delhi High Court recently issued a notice to the Telecommunication Department on a petition seeking the records of the review committee that authorised the interception of phone calls in a bribery case.

A single bench of Justice Dinesh Kumar Sharma a plea by former High Court judge Justice IM Quddusi seeking records of the review committee which had allowed interception of telephone calls in connection with the medical college bribery case.

The bench also issued notice to the Central Bureau of Investigation (CBI) in the matter.

In his petition, Justice Quddusi also requested that the CBI expunge the intercepted messages and not rely on them in the case against him.

The Case-

Justice Quddussi, a former judge of the Allahabad, Orissa and Chhattisgarh High Courts, has been implicated in the case by the CBI.

The CBI has charged him with violating the Prevention of Corruption Act and Section 120B of the Indian Penal Code.

In the past, the Central Government barred Prasad Institute of Medical Sciences’ 46 colleges from admitting students for the academic years 2017-18 and 2018-19. The trust appealed to the Supreme Court, which ordered the government to reconsider the materials on file and reconsider the grant of the letter of permission to operate the college.

According to the CBI, while the case was before the Supreme Court, Justice Quddusi attempted to influence certain “high-level functionaries” to tilt towards the outcome of the dispute and get the matter settled in the trust’s favour using his contacts.

In connection with the case, the CBI arrested Justice Quddusi in September 2017.

The bench has scheduled the matter for further consideration on July 7, 2023.
