Delhi HC On Bail Plea Of Former AAP Councillor Tahir Hussain: ‘Nomination Can Be Filed Even While In Jail’

The Delhi High Court in an oral remark on Monday said that the nomination can be filed even while being in jail.

The bench led by Justice Neena Bansal Krishna made these remarks during a hearing on the bail petition of former Aam Aadmi Party councillor Tahir Hussain.

He is accused in the murder case of IB employee Ankit Sharma during 2020 Delhi Riots.

Delhi Police opposed the interim bail petition of the former AAP councillor.

He has sought interim bail from Delhi High Court to contest Delhi Assembly elections.

Additional Solicitor General Chetan Sharma, appearing for Delhi Police, opposed the interim bail and said that Tahir Hussain can file nomination even while being in jail.

There are many such examples where nominations have been filed from jail.

The lawyer appearing for Tahir Hussain said that since All India Majlis-e-Ittehadul Muslimeen (AIMIM) is a recognized political party. Therefore, he will have to file accounts of all his assets.

Additionally, a proposal for nomination will have to be submitted.

To this, Justice Krishna commented that nomination can be filed even while sitting in jail.

The court will continue the hearing on the interim bail petition filed by Hussain on January 14.

Background

Tahir Hussain has recently become a member of Asaduddin Owaisi’s party AIMIM and the party has made him its candidate from Mustafabad constituency.

Tahir has said in the petition that he should be granted interim bail so that he can contest the Delhi Assembly elections.

Earlier, A Delhi Court refused to grant bail to Tahir Hussain in the murder case of an IB employee. The lower court had refused to grant bail on December 3.
