Delhi HC Quashes Cheating FIR Against Ashneer, Wife

The Delhi High Court has recently quashed the FIR filed against businessman Ashneer Grover and his wife Madhuri Jain Grover for alleged offences of cheating and forgery.

Justice Chandra Dhari Singh, upon hearing the petition filed by Madhuri Jain Grover and others, decided to quash the FIR registered by the Delhi Police Economic Offences Wing in 2023.

Subsequently, another bench led by Justice Sanjeev Narula directed the Bureau of Immigration to cancel the Look Out Circular issued against Ashneer Grover and his wife. The couple had previously challenged the issuance of the LOC.

The petitioners, including Madhuri Jain Grover, approached the court seeking the quashing of the FIR, which was filed under various sections of the Indian Penal Code, including 406, 408, 409, 420, 467, 468, 471, and 120B, at the EOW Police Station in New Delhi.

The petitioners argued that the dispute between them and the complainant, M/s Resilient Innovations Private Limited, had been settled on September 30.

Senior advocate Mohit Mathur, representing the petitioners, informed the court that all issues had been resolved between the parties and requested time to file an affidavit confirming compliance with the terms of the settlement agreement.

Following the quashing of the FIR, Justice Narula noted that the LOC issued against Ashneer Grover and Madhuri Jain Grover would no longer be valid. He ordered the Bureau of Immigration to remove the LOC from their records, as the underlying FIR had been quashed. Justice Narula further emphasized that the LOC could not stand after the FIR was nullified.

Ashneer Grover and Madhuri Jain Grover had contested the issuance of the LOC, which was originally triggered by the FIR filed by the EOW. The Grovers’ legal counsel, Advocate Giriraj Subramanium, argued that the quashing of the FIR meant the LOC had no legal basis to remain in effect.

The court, in light of this, disposed of the petitions and directed the respondents to cancel the LOC against the Grovers.
