The Delhi High Court has issued an interim injunction in favor of renowned filmmaker Mukesh Bhatt, prohibiting T-Series and any associated parties from using the titles “Tu Hi Aashiqui” or “Tu Hi Aashiqui Hai,” or any other title featuring the mark “Aashiqui” for their upcoming film.
This decision is part of an ongoing dispute over intellectual property rights related to the “Aashiqui” brand.
On Monday, Justice Sanjeev Narula’s order emphasized that the “Aashiqui” title is more than just a single instance; it is part of a successful film series, with notable entries from 1990 and 2013.
Mukesh Bhatt’s company, Vishesh Films Private Limited, has filed a lawsuit against T-Series’ Super Cassettes Industries Limited over their plans to develop a third installment of the “Aashiqui” series. The disagreement surfaced when T-Series announced film titles similar to “Tu Hi Aashiqui” or “Tu Hi Aashiqui Hai,” which Bhatt’s team argues could cause confusion and mislead audiences. Bhatt and T-Series had previously collaborated on the first two “Aashiqui” films with mutual consent.
T-Series acknowledges joint ownership of the “Aashiqui” franchise but denies any intention to produce a new installment or related works. They argue that their proposed titles are distinct from Bhatt’s trademarks and do not serve as a sequel. T-Series also stated that their film will be entirely separate from the “Aashiqui” franchise.
Vishesh Films contends that T-Series is infringing on their proprietary rights to the “Aashiqui” franchise, despite their joint ownership under prior agreements. The companies previously worked together on the celebrated films “Aashiqui” (1990) and “Aashiqui 2” (2013), which have become iconic in Indian romantic cinema.
