The Delhi High Court has recently sought a response from Delhi Urban Shelter Improvement Board on a plea moved by a Specially Disabled.
The petitioner, who has been blind since birth and lacks a means of livelihood, is seeking an order from the authorities to allocate a sample house and plot in compliance with the Rights of Persons with Disabilities Act of 2016.
Justice Subramonium Prasad has issued a notice to DUSIB, granting them 4 weeks to respond.
The court has scheduled the hearing for November 21, this year. Pawan Kumar, represented by advocate Jatin Mongia, has filed the current petition.
The petitioner has sought direction from various authorities, including DUSIB, the Delhi Government, DDA, Department of Social Welfare, Central Government, and Department of Urban Development, for the allocation of sample houses and plots in the Trilok Puri and Kalyan Puri areas of East Delhi.
The petitioner, who relies on a nominal disability allowance of Rs 2,500 per month as their sole source of income, seeks shelter in accordance with the RPWD Act of 2016 to improve their quality of life and dignity.
The plea highlights the petitioner’s visual disability and their history of residing in rented accommodations within Kalyanpuri.
Despite the petitioner’s confirmed visual disability and numerous requests to authorities for the formulation of policies on allotment of vacant houses and plots in Trilokpuri and Kalyanpuri, the respondent authorities have failed to comply with their obligations under the RPWD Act of 2016.
The petitioner argues that the Indian government has a constitutional duty towards people with disabilities, as recognized by the Indian Constitution and the United Nations Convention on the Rights of Persons with Disabilities.
The petitioner has made several written appeals to the authorities for the allocation of sample houses and plots.
