Delhi HC to Hear AAP’s Plea for Office Space Allocation on May 20

The Delhi High Court has scheduled a hearing on May 20 for petitions filed by the Aam Aadmi Party (AAP), seeking allocation of space for its offices by the Centre due to its status as a recognized national party. Justice Subramonium Prasad noted that despite a suggestion to allocate a unit on Deen Dayal Updhayay (DDU) Marg, which is with a minister in the AAP government, authorities did not accept it.

The matter, the judge emphasized, needs resolution, especially in light of ongoing Lok Sabha elections and the upcoming assembly polls next year.

AAP’s Plea

The AAP, facing eviction from its current party office in Rouse Avenue by June 15, had approached the court last year seeking allotment of a housing unit on license basis or a piece of land in the national capital for constructing its offices.

Central Govt’s Offer

The central government counsel informed the court that an offer of permanent land allotment in Saket area was made last year, but the AAP objected, arguing it wasn’t at par with allotments to other national parties.

Justice Prasad questioned if there was a waiting list for national parties seeking space allocation and stressed the government’s obligation to adhere to Article 14 (Equality before law). The court also inquired about the criteria for such allotments. The court’s decision to hear the matter on Monday underscores the urgency, especially during the election period.

The AAP contends that it’s entitled to office space, citing policies issued by the Union ministry. It asserts that denial of land hampers its functioning and violates democratic principles.

The petition seeks a directive for the Union ministry to allocate suitable land in a centrally-located area of Delhi without encumbrances, enabling immediate construction of its offices.
