Delhi HC Turns Down Another Plea Against Centre’s Decision To Revoke Celebi’s Security Clearance

The Delhi High Court on Thursday dismissed a petition filed by Turkey-based company Celebi Ground Handling India Private Limited, challenging the Central Government’s Bureau of Civil Aviation Security (BCAS) decision to revoke its security clearance citing “interest of national security.”

Justice Tejas Karia pronounced the verdict and rejected the plea, noting that the issues raised were already addressed in earlier petitions.

Earlier Petitions Dismissed By Coordinate Bench

On July 5, a coordinate bench had dismissed similar pleas filed by two other Turkish-linked entities, Celebi Airport Services India Private Limited and Celebi Delhi Cargo Terminal Management India Private Limited. These companies had also challenged the revocation of their security clearances by the Indian government.

Justice Karia observed that the current petition raised identical issues already considered by the single judge, stating, “The petition is accordingly dismissed.”

National Security Takes Precedence Over Natural Justice

In its earlier judgment, the coordinate bench acknowledged that while natural justice is a fundamental constitutional principle, it must yield when it comes to protecting “security of the realm.” The bench underscored the importance of preserving national security above procedural norms in such cases.

The court noted that the Union Government’s decision to revoke Celebi’s security clearance was driven by “compelling national security considerations.”

Government’s Stance On Security Clearance Revocation

The Indian government had withdrawn the security clearance of Celebi and its related companies due to concerns linked to national security.

The revocation affects Celebi’s operations at airports, directly impacting their ability to provide ground handling and cargo services.
