Delhi High Court Restrains Kannada News Network to Use Vistara as Trade Mark

The Delhi High Court restrains ‘Vistara News’ from using Vistara Trade mark. The Court has passed this order on a suit filed by TATA SIA the owner of Vistara airline.

A Karnataka-based news network called Vistara News received an interim order restraining the use of the trademark ‘Vistara’ after Tata SIA Airlines (owners of Vistara Airlines) filed a trademark infringement suit.

‘Vistara News’ is a Karnataka Based Kannada news network. It has been restrained from using the variations of ‘Vistara’ in any native language, including Kannada.

Delhi High Court Single Bench of Justic Jyoti Singh ordered that till the next date of hearing, Defendant and all others acting for and on its behalf are restrained from using Plaintiff’s registered and well-known trademark VISTARA, in any form or manner whatsoever including but not limited to its variations in any native languages such as Kannada, amounting to infringement and are also restrained from passing off its services or goods as that of the Plaintiff (Tata SIA Airlines) the court ordered.
The Court was told that, as Vistara is declared a well-known trademark, Vistara is entitled to the highest degree of protection.

In continuation, it was further argued that Vistara News (the defendant) has done duplicity and copied the trademark and can have no reasonable reason for its adoption, and it’s clear that the objective is to confuse the customers into believing that the services and packages offered by the defendant originate from the plaintiff.

Notices were issued by the Court directing the defendants to file written statements within 30 days.
The matter will be placed before the Joint Registrar on February 1, 2023.Prior to September 2022, the Delhi High Court granted a permanent injunction against a company selling keychains and baggage tags bearing the ‘VISTARA Marks.
