Delhi Police Files Charge Sheet Against Deepak Boxer in MCOCA

The Delhi Police has recently filed a charge sheet in Patiala House Court against gangster Deepak Boxer in a case registered under the Maharashtra Control of Organized Crime Act (MCOCA). It is alleged that Deepak Boxer is a member of a crime syndicate of the Jitender alias Gogi gang.

Fifteen other accused individuals in the case are already in custody, and a charge sheet has been previously filed against them. The court has recently denied an extension of the investigation period related to Deepak Boxer.

Subsequently, the Delhi Police filed a supplementary charge sheet against him. Special Judge Shailender Malik has scheduled the hearing of the charge sheet for July 28, 2023.

In the previous order, the court refused to extend the investigation period beyond 90 days, emphasizing the expectation that the investigating agency should conduct the investigation diligently and without unnecessary delays.

The court stated that such an exercise is not a mere formality, as it involves the accused’s valuable right to liberty.

Special Judge Malik pointed out that the report of the Public Prosecutor did not provide specific reasons for seeking an extension of the accused’s judicial detention.

The judge highlighted that incomplete steps in the investigation, such as obtaining certified copies of criminal cases involving Deepak Boxer and collecting details of his income tax and properties, can’t be valid grounds for extending judicial detention.

The court stated that it would not act solely on the instructions of the investigating agency and ordered a copy of the order to be sent to the concerned officials.

The extension of the investigation period was requested in order to collect certified copies of cases against the accused and to obtain details from the Chief Commissioner of Income Tax regarding the accused’s PAN card and income tax returns for the last 10 years.

Deepak Boxer, who was previously declared a proclaimed offender in this case on December 9, 2020, was formally arrested in this case on April 15, 2023, after being arrested in another FIR by the Special Cell.

While the investigation is almost complete, certain aspects remain pending, leading to the application for an extension.
