The Delhi High Court on Tuesday sets aside Delhi Mayor Shelly Oberoi’s decision to re-elect six members of the Municipal Corporation of Delhi (MCD) standing committee.
Justice Purushaindra Kumar Kaurav passed the order stating that Oberoi’s decision to reject the ballot of one of the persons was bad in law, because the decision was not based on any material, and her actions were without any power or authority.
The court has now ordered Oberoi to declare the election results as per the voting held on February 24. The rejected ballot should also be counted, according to the single-judge.
The plea was filed by two BJP councillors, Kamaljeet Sehrawat and Shikha Roy, who had moved before the High Court seeking orders to Shelly Oberoi to declare the results of the February 24 election for six members of the MCD’s standing committee.
They also urged that the mayor’s notice asking for the re-election of members of the standing committee be quashed.
Oberoi, a member of the Aam Aadmi Party (AAP), passed an order by which she ordered for new elections for the MCD Standing Committee.
Sehrawat and Roy argued in their petition that the mayor’s decision was invalid because the elections had been effectively conducted, with the BJP and AAP each winning three seats.
The Court had stayed Oberoi’s directives in an interim order passed on February 25.
