Dy CM Sisodia in CBI Custody: It was a Rough Sleepless Night instead of Adequate Amenities

Arrested Dy CM Manish Sisodia had a rough first night in CBI custody. Sources close to the CBI told Legally Speaking that Manish Sisodia had sleepless nights, although adequate facilities were provided to Manish Sisodia by the CBI. But he still looked restless. After the night’s interrogation, the CBI officers allowed him to sleep regularly at night.

Delhi Deputy Chief Minister Manish Sisodia will not be charged with third degree, Special Rouse Court ordered on Monday allowing CBI to keep him in custody.

Delhi’s Rouse Avenue court on Monday sent Deputy Chief Minister Manish Sisodia to a five-day CBI remand in the excise policy case. The court gave the order to allow the central agency to get “genuine and legitimate” answers to questions being put to Sisodia for “a proper and fair investigation”.

Special judge MK Nagpal passed the order on a CBI plea, who produced the AAP leader before the court amid heavy security a day after arresting him.

The judge said that though the accused had joined the investigation of this case on two earlier occasions, it has been observed that he “failed” to provide satisfactory answers to most of the questions put to him during his examination and interrogation.

“A proper and fair investigation requires that some genuine and legitimate answers to the questions being put to him about the same are to be found and hence, in considered opinion of this court, this can only be done during custodial interrogation of the accused,” the judge said.

Judge Nagpal added that as far as the apprehensions being expressed by senior counsels regarding the use of any force or third-degree methods for extracting information from the accused are concerned, “this court does not expect the same from the officers of CBI who have been given the task of interrogating the accused holding the high post of deputy chief minister of the GNCTD and also some other important portfolios”.

In any case, such apprehensions can always be taken care of by imposing certain conditions, the judge said. Conditions are as followed:

1-The interrogation of the accused during this period shall be conducted in some place having CCTV coverage. The footage shall be preserved by the CBI.

2- As per the judge’s order, Sisodia should be medically examined once every 48 hours.

3- The judge also permitted Sisodia to meet his advocates for half an hour every day between 6 pm to 7 pm during his CBI custody. The agency officials are not able to hear their conversations.

4- Besides this, he shall be permitted to meet his wife every day for a duration of 15 minutes.

5- Manish Sisodia will also be allowed to take certain medicines prescribed to him.
