Former Delhi Deputy Chief Minister Manish Sisodia has recently approached the Delhi High Court, contesting a trial court’s decision to take cognizance of the ED’s chargesheet in the Excise Policy case.

Sisodia’s plea argues that the chargesheet was filed without prior sanction from competent authorities, as required by law. He contends that the allegations stem from official actions performed during his tenure as a public servant, making the prosecution without appropriate sanction unlawful.

“The impugned supplementary prosecution complaint (chargesheet) was filed without obtaining prior sanction from the competent authority,” Sisodia’s petition states. It further claims that the trial court’s decision contradicts established legal precedents, rendering the proceedings invalid.

The plea seeks to quash the trial court’s order and nullify all related proceedings. The matter will be heard by Justice Manoj Kumar Ohri of the Delhi High Court on Monday.

Background

Sisodia was arrested in February 2023 in connection with alleged irregularities in the Delhi Excise Policy. The Supreme Court granted him bail in August in two cases related to the scam, involving accusations of money laundering and corruption, filed by the Central Bureau of Investigation (CBI) and the ED.

This latest challenge highlights Sisodia’s continued legal battle to contest allegations tied to his time in public office.
