The Saket Court has recently dismissed the plea of an accused, asserting that a woman’s intoxicated state can’t provide a license to exploit her condition for the benefit of her male acquaintance.
The accused attempted to kiss the complainant when she resisted, he slapped her forcefully.
Additional Sessions Judge Sunil Gupta stated that, the prosecution has successfully demonstrated that the accused employed criminal force against the complainant. The complainant suffered injury due to the slap.
Furthermore, the court noted that while the complainant’s medical examination revealed her intoxicated state at the time, a woman’s intoxication doesn’t grant an unauthorized advantage to her male friend. The court also rejected Sandeep Gupta’s argument that the complainant compelled him to meet and converse with her.
On February 5, 2019, the Magistrate’s Court pronounced Sandeep Gupta guilty under sections 354 (assault or criminal force to woman with intent to outrage her modesty) and 323 (voluntarily causing hurt) of the Indian Penal Code (IPC).
Due to dissatisfaction with this verdict, the accused challenged it in the Saket Court.
