Madras HC Stays Recommendations For A Probe Into Former CM Jayalalithaa’s Death

The Madurai Bench of the Madras High Court recently stayed the recommendations in the final report of a panel investigating former Tamil Nadu CM Jayalalithaa’s death.

A single bench of Justice GR Swaminathan passed the interim order in a petition filed by the former Tamil Nadu health minister Dr C Vijayabaskar.

Justice Arumughaswamy Commission of Investigation’s final report has been called into question when a former state minister attempted to have portions of it annulled.

The final report was submitted by the panel exploring charges against the C. Vijayabaskar, in connection with the death of Jayalalithaa.

In his petition, Vijayabaskar sought to have sections of the report and following government orders (GO) quashed.

The former health minister stated that he was called by the inquiry commission only as a witness, but if it intended to indict or prosecute him, it should have given him notice and an opportunity to present his defence.

In its final report, the inquiry commission suggested the Tamil Nadu government to launch an additional investigation into the roles played by VK Sasikala, Dr. KS Sivakumar, former health secretary Dr. J Radhakrishnan, and former health minister Dr. C Vijayabaskar with regard to Jayalalithaa’s hospitalisation and demise.
