The Madhya Pradesh government has filed a petition in the Supreme Court against the declaration of Section 10 of the Madhya Pradesh Freedom of Religion Act 2021 as unconstitutional by the High Court.

During the hearing of the case on Tuesday, the Supreme Court refused to give relief to the Madhya Pradesh government. The Supreme Court has refused to stay high court order. The Jabalpur High Court made it clear that if two adult citizens are marrying in a different caste or religion against their own free will, then no action can be taken against them.

While giving an interim order, the Jabalpur High Court termed Section 10 of the Madhya Pradesh Freedom of Religion Act 2021 as unconstitutional. The Jabalpur High Court restrained the state government from taking action against any person who violates Section 10 of the Freedom of Religion Act.

Under this section, it was made mandatory to give information to the District Magistrate i.e. Collector 60 days before the marriage to the person marrying in another religion and for not doing so, a provision of imprisonment for 2 years was made.
