The Delhi High Court on Monday declined to entertain a petition that sought directions for the authorities to re-frame the guidelines for coaching institutes with criminal liability.
The plea also requested that the authorities be directed to develop an education system focused on refining students’ minds rather than solely preparing them for entrance examinations.
A bench comprising Acting Chief Justice Manmohan and Justice Tushar Rao Gedela stated that issuing such a direction was beyond the court’s jurisdiction.
“This is not within our domain. Even if the education system needs reform, it is not for us to undertake. If there are flaws in the education system, the elected government will face the consequences in the elections,” the bench remarked.
“We cannot formulate the education system for the city,” it added.
The court was hearing a plea filed by the non-profit organization Kutumb, which also sought directions for the authorities to frame rules and regulations for operating paying guest accommodations for students in Delhi.
As the court was not inclined to entertain the plea, the petitioner’s counsel, Rudra Vikram Singh, requested permission to withdraw the petition.
The court allowed the petitioner to withdraw the petition with the liberty to approach an appropriate forum with its representation.
During the hearing, MCD’s counsel, Manu Chaturvedi, informed the court that the Supreme Court is currently handling the matter concerning the safety of students in coaching centres.
The petition also sought the constitution of a committee to investigate and compile a report on coaching institutes operating illegally and not adhering to standard norms.
