Petition Before Delhi HC Challenging The Discontinuation Of Dialysis To EWS Patients

A petition has been filed in the Delhi High Court challenging Venkateshwar Hospital, Dwarka’s decision to discontinue dialysis services for EWS patient Jitender Pal Singh.

A single Judge bench of Justice Pratibha M. Singh issued notice to the respondents and the Delhi Development Authority (DDA) has been ordered to provide land allotment documents.

According to the petition, it is aimed against the hospital’s conduct in stopping dialysis services to Jitender Pal Singh despite the fact that the new dialysis unit is running on Government property with the stipulation of providing free treatment to Economically Weaker Section (EWS) patients.

The plea stated, “That the land on which the dialysis unit is now operational is also on respondent DDA land, and at the time of providing land to respondent Hospital, the condition of providing free of cost treatment to EWS patients was incorporated, therefore, they are bound to provide minimum 10% IPD and 25% OPD facility to EWS patients as the new building is also part and parcel of respondent Hospital for all intents and purposes.”

The petitioner further claimed that the hospital’s and the Delhi Development Authority’s (DDA’s) acts violate his fundamental rights as provided by Articles 14, 19, 21, and 47 of the Indian Constitution.

“It is submitted that respondent Hospital’s action of discontinuing the dialysis facility to petitioner is arbitrary, unjust, unconstitutional, inhuman, and in violation of directions given by Hon’ble Supreme Court in Moolchand Khairati Ram Trust & Ors (2018) 8 SCC 321,” the plea stated.

According to the petitioner, a legal notice was issued to the Hospital, the Government of the NCT of Delhi, and the DDA on February 17, but no answer has been received.

The matter has been scheduled for further consideration in July 2023.
