Reconsidering Decision of Making Aadhar Card & Voter ID With Delhi Or NCR Address Mandatory For Enrolments: BCD To DHC

The Delhi Bar Council informed the Delhi High Court on Monday that it is reconsidering the recent notification requiring the filing of an Aadhar Card and a Voter ID with an address of Delhi or the NCR region mandatory for future enrolment.

The counsel appearing for the lawyers’ body told Justice Prathiba M Singh that the matter will be reconsidered by the BCD at its meeting on May 12.

The court was hearing two pleas moved by law graduates challenging the notification as being arbitrary and discriminatory.

The court adjourned the case and asked the Bar Council of India to file a brief affidavit on the issue raised.

“Since the matter has been stated to be under reconsideration by the Bar Council of Delhi, list on May 23,” the court remarked.

According to the notification issued by BCD, the lawyers’ body stated that law graduates who intend to apply for enrolling must include a copy of their Aadhar card and voter ID card from Delhi or NCR with their enrolment application.

“No enrolment shall be made thereafter unless accompanied by a copy of Aadhaar Card and Voter ID Card bearing the address of Delhi/NCR,” the notice added.

Advocate Rajani Kumar, a law graduate from Campus Law Centre, Delhi University, and a Bihar resident, is one of the petitioners.

It is her contention that the necessary requirement of providing the aforementioned documents discriminates against law graduates who do not reside in Delhi or the NCR, as well as establishes an arbitrary classification between law graduates based on their residence address.
