Rouse Avenue Court Denies ‘Default Bail’ To AAP’s Vijay Nair

Rouse Avenue court has recently rejected the plea of former AAP communications in-charge, Vijay Nair, who sought ‘default bail’ in connection with a money laundering case linked to the alleged Delhi excise policy scam.

The court rejected Nair’s plea, citing the prior rejection of his request for regular bail by the Delhi High Court.

Nair’s bail application was depicted on the grounds that ED had submitted an “incomplete prosecution complaint” against him.

The judge stated that the current court was not the appropriate forum to address the grounds for default bail and advised Nair to approach the same judge or bench at the High Court.

As a result, the plea was dismissed as “not maintainable” before the court.

Nair sought default bail, contending that the supplementary prosecution complaint filed by the ED was incomplete, as the investigation against him had not been fully concluded.

He argued that allowing incomplete charge sheets would undermine the principles of criminal jurisprudence.

However, ED opposed Nair’s application, affirming that the investigation concerning him had been completed at the time the prosecution complaint was filed.

While further investigations were ongoing to trace other offenders and establish the proceeds of the crime, the agency asserted that the prosecution complaint was not rendered incomplete or piecemeal.

The case relates to the cancellation of the Delhi excise policy last year, following a recommendation by the Delhi lieutenant governor for a CBI inquiry into alleged irregularities involving government officials, bureaucrats, and liquor traders.

The ED initiated its case based on the FIR lodged by the CBI.
