Allahabad HC Adjourns Hearing in Shri Krishna Janmabhoomi-Shahi Idgah Case

The Allahabad High Court on Wednesday adjourned its hearing in the Krishna Janmabhoomi-Shahi Idgah case and directed the Hindu side to submit its response to a plea challenging the suit’s maintainability.

This development followed the Supreme Court’s stay on Tuesday, preventing the implementation of the high court’s order allowing a court-monitored survey of the mosque complex adjacent to the Krishna Janmabhoomi temple in Mathura.

Upon resumption of proceedings on Wednesday, a copy of the Supreme Court’s order was presented in the high court. Justice Mayank Kumar Jain stated that an application under Order 7 Rule 11 of the Civil Procedure Code, addressing the maintainability of the suit, needs to be filed. The court indicated that the next hearing date for the case will be decided later.

On December 14, 2023, the high court had granted permission for a court-monitored survey of the Shahi Idgah complex and approved the appointment of an advocate commissioner to oversee the examination of the mosque premises. The petitioners argue that the premises show indications of being a Hindu temple in the past. The mosque management committee contested the high court’s survey order in the Supreme Court.

In Tuesday’s proceedings, a bench of Justices Sanjiv Khanna and Dipankar Datta stayed the execution of the high court’s December 14 order. However, the Supreme Court clarified that the proceedings before the high court on matters including the suit’s maintainability under Order 7 Rule 11 of the CPC would continue.
