The Allahabad High Court has directed the State government to contemplate the regularization of teachers appointed between 1993 and 1996 in various management colleges across the state.
Regional Level Committees
A single bench of Justice Shree Prakash Singh issued the directive following the annulment of orders by Regional Level Committees (RLCs) that had rejected the regularization of these teachers’ services.
Several teachers had challenged the committee orders overseen by the regional joint director of education before the court. Upon reviewing the evidence, the bench invalidated the RLCs’ orders, remarking that they seemed hastily made.
Court’s Observation
The petitioners have been employed for over two decades, noted the bench, emphasizing that “the state should function as a welfare state by considering their regularization in compliance with the law and providing them with a full hearing opportunity.”
The bench has allotted three months to the RLCs to issue fresh orders concerning the regularization of the teachers, while taking into account the relevant provisions.
