Allahabad HC Issues Notice to BJP MP KV Singh in Property Dispute Case

The Allahabad High Court issued a notice to BJP MP from Gonda, Kirti Vardhan Singh, during the hearing of a writ petition involving a property dispute between two private parties.

After considering the case, the bench directed the Uttar Pradesh Director General of Police (DGP) to ensure the transfer of Manakpur Police Station SHO SK Singh and AK Rai, a crime branch inspector, outside the district while the investigation into the matter proceeds. The dispute revolves around a writ petition filed by Gurbachan Kaur and her two sons, in which they alleged that, at the behest of the MP, certain policemen intruded into her residence on September 15 and demanded that she vacate the premises.

Kaur further claimed that on the following day, unidentified individuals again entered her house and reiterated the demand. The counsel representing the petitioners, Rishad Murtaza, presented the case before a bench comprising Justices Sangeeta Chandra and NK Johari. Murtaza argued that Kulwant Kaur and her supporters were attempting to seize Gurbachan Kaur’s property and that the SHO and crime branch inspector had visited the petitioners’ residence allegedly under the influence of the local MP, intimidating them to vacate the premises.

The counsel asserted that the policemen’s visit to the disputed property is evident from the Superintendent of Police’s report, and strict action should be taken against them as they lacked the authority to interfere in a civil dispute. Following the hearing, the court issued a notice to Kirti Vardhan Singh, seeking his response to the allegations, while instructing the DGP to facilitate the transfer of the SHO and the inspector.

The bench also asked the petitioners to approach the appropriate court for the registration of an FIR against the policemen and other individuals who had intruded into their residence. In addition, the bench scheduled the next hearing in the matter for October 18 and directed the respondents to submit their counter affidavits.
