Allahabad HC Rejects Petition Against Demolition Of Mosque In UP’s Sambhal

The Allahabad High Court on Saturday dismissed a writ petition challenging the demolition of a mosque in Sambhal district, allegedly constructed on pond land.

The order was passed by Justice Dinesh Pathak. The petition was filed by the mosque committee, which argued that the local Muslim community had been praying peacefully at the mosque in Gosulbara Ravan Bujurg since 2009.

The petitioners claimed that no proper notice or opportunity for a hearing was provided before the demolition order was issued.

Further, it highlighted that the matter was urgent, as the demolition order coincided with the Dussehra vacation, and emphasized the need for the court’s intervention before the order could be executed.

Government’s Response

The government side contended that the petition was not maintainable, arguing that proper legal procedures had been followed.

According to the petition, the authorities had purportedly issued the demolition order on September 2, 2025, but the petitioner claimed that it was never formally served until October 2.

On September 30, a notice was issued informing the petitioner of proposed demolition, explicitly referring to the September 2 order, stating that demolition would be undertaken “in terms of order dated 02.09.2025.”

Despite October 2 being a public holiday for Dussehra, the petition alleged that officials of the district administration arrived at the mosque with bulldozers and demolition equipment, allegedly threatening immediate demolition.
