The Allahabad High Court granted bail to Nizamuddin Khan, the State President of the Social Democratic Party of India (SDPI) in the UAPA case, for his alleged involvement with the banned organisation Popular Front of India (PFI) and anti-national activities.
A single bench of Justice Ajit Singh was hearing the matter.
Nizamuddin Khan has been accused of using the PFI to recruit youth against the central and state governments, as well as the Rashtriya Swayamsevak Sangh (RSS).
After his bail application was denied by the Sessions Court in Aligarh, he moved to the High Court seeking regular bail.
Khan’s counsel contended that there is no evidence on record to show that the applicant is involved in any anti-national activity, nor has he in any way harmed the religious sentiments of any community.
Additionally, it was asserted that he is completely innocent and has been wrongfully accused in this case with the secondary goal of harassing him.
The final argument made was that he has no criminal past, has been imprisoned since September 27, 2022, and, if released on bond, will cooperate during the trial and not abuse the freedom granted by bail.
Despite the state’s attorney’s opposition to his request for bail, the court determined that he was qualified to be expanded on bail while the case was pending based on the facts of the case, the evidence, the accused’s complicity, the severity of the punishment, and the arguments made by the parties’ learned attorneys. The court made this determination without opining on the case’s merits.
As a result, the Court ruled that he may only be released on bail after posting a personal bond and providing two sureties, each for a sum equal to his bail, to the satisfaction of the relevant court.
