‘Amaravati’ Andhra Capital Issue: SC Says High Courts Can’t become town planners

The Supreme Court on Monday  issues notice on Andhra Pradesh Government’s plea against Andhra Pradesh High Court ruling of declaring “Amaravati” as state’s capital. Courts can’t become town planners, observes the top court

A bench of justices KM Joseph and BV Nagarathna also stayed Andhra Pradesh High Court’s directions of asking state to develop construct and develop Amaravati capital city and capital region within 6 months.

The Supreme court was hearing an appeal filed by the YS Jagan Mohan Reddy government. We will examine the legal questions involved in the matter on January 3, the Court said

On September 17, the YSR Congress party-led government filed the SLP, challenging the March 3 judgment by the state’s high court that upheld Amaravati as the only capital of Andhra Pradesh while declaring that the state legislature had no competence to pass any legislation forming the three capitals.

The government also challenged the high court’s observation that the state legislature has no legal competence to pass the legislation on three capitals, saying it was in contravention of the principle of separation of powers between various organs of governance, which is a basic structure of the Constitution.
