Anubrata Mondal Case: Calcutta HC Grants Permission To Birbhum SP To Challenge Summons

The Calcutta High Court on Tuesday permitted the Superintendent of Police of Birbhum district to file a petition challenging a summons issued by the National Commission for Women in connection with alleged derogatory remarks made by TMC leader Anubrata Mondal.

SP Seeks Relief From NCW Summons

Appearing before Justice Tirthankar Ghosh, a lawyer representing the SP sought leave to contest the NCW’s directive requiring the officer’s personal appearance on July 14. Justice Ghosh allowed the petition to be filed and scheduled the matter for hearing on Wednesday, instructing the petitioner to serve copies of the plea to all relevant parties.

Allegations Of Overreach

The SP’s counsel told the court that the NCW was allegedly interfering in an ongoing investigation in Birbhum district. The lawyer further argued that the Commission was attempting to influence the probe by pressuring the police to add specific charges and present the case diary, despite the matter being sub judice.

Background Of Case

The summons stems from an FIR filed against Anubrata Mondal for reportedly making derogatory remarks during a phone conversation with the officer-in-charge of the Bolpur police station.

The case includes charges under relevant sections of the Bharatiya Nyaya Sanhita (BNS).

Previously, the NCW had expressed dissatisfaction with the action taken report submitted by the SP in response to the alleged incident.

The court will hear the SP’s challenge on Wednesday, once all procedural requirements are met. The outcome could determine the scope of the NCW’s authority in summoning state police officials during ongoing criminal investigations.
