Bhima Koregaon Case: Bombay HC Denies Default Bail to 5 Accused Individuals

The Bombay High Court on Friday refused default bail to Surendra Gadling, Mahesh Raut, Rona Wilson, Sudhir Dhawale, and Shoma Sen in connection with the Bhima Koregaon violence case.

A bench comprising Justices AS Gadkari and Shyam C Chandak issued the order on pleas filed by the five accused, challenging the 2022 special court orders that had denied them default bail.

The five individuals were arrested under the Unlawful Activities (Prevention) Act (UAPA) in June 2018. Gadling approached the High Court against a special court’s order dated June 28, 2022, which rejected his default bail application. Raut, Wilson, Dhawale, and Sen filed appeals against a similar order from June 26, 2022.

Raut had been granted regular bail by the Bombay High Court last year. However, the High Court had stayed the order for a week after the NIA sought time to file an appeal before the Supreme Court. The NIA then moved the Supreme Court, which extended the stay further. Raut, who was arrested in June 2018, has remained in custody since.

On April 5, the Supreme Court granted bail to Sen. Gadling, Wilson, and Dhawale remain in custody.
